Functions of Municipal Councils
– Planning and Development Committee
Article (45)
The committee is responsible for the following:
1- Reviewing the plans for streets and modern roads prepared by the relevant authorities and expressing its opinion on them before their approval by the competent authorities.
2- Reviewing plans for the construction and designation of streets, roads, and other related infrastructure, and making recommendations regarding them to the relevant authorities.
3- Reviewing the regulatory plans for new areas proposed by the government for planning and expressing its opinion on them.
4- Studying the rules and procedures related to the sale and utilization of properties owned by the council and the use of public facilities falling within the municipality’s jurisdiction.
5- Studying the organization of engineering offices, building permits, demolition, renovation, and building modifications in coordination with the relevant authorities.
6- Studying the systems and regulations related to advertising permits, the placement of promotional and commercial names, proposing related fees, and also permits for occupying public roads in coordination with the relevant authorities.
7- Studying the establishment of sewage projects, taking into account the Department of Public Works in matters related to this.
8- Other matters referred to it by the council.
– Committee for Violations, Health Services, and Environmental Protection
Article (46)
The committee is responsible for the following:
1- Studying the best methods for cleaning squares, streets, public roads, and beaches.
2- Studying regulations that ensure public cleanliness and environmental protection from pollution, waste collection, landfill site determination, and methods of disposal or recycling, in accordance with the latest scientific and economic methods, and in coordination with relevant authorities.
3- Studying regulations concerning housing animals in homes, determining locations for livestock and poultry pens, and addressing issues related to stray and loose animals and their disposal as necessary, while monitoring the development of current legislation on these matters.
4- Studying regulations concerning public, commercial, industrial, hazardous, and disturbing establishments concerning comfort, health hazards, and street vendors, in coordination with relevant authorities.
5- Providing input on monitoring and preventing panhandling and all behaviors that violate regulations and traditions in coordination with other committees and relevant authorities.
6- Monitoring decisions and legislation related to health services, environmental matters, and environmental protection.
7- Monitoring beach pollution (oils, waste) and preserving the marine environment.
8- Proposing regulations related to public health in coordination with relevant authorities.
9- Monitoring the implementation of laws and regulations related to food prepared for human and animal consumption in coordination with relevant authorities.
10- Receiving complaints and suggestions regarding the above.
11- Proposing violation regulations and fines related to public cleanliness and environmental protection, and in all matters mentioned above, in coordination with relevant authorities.
12- Addressing other issues referred to it by the council.
– Traffic, Transport, Ports, and Public Facilities Committee
Article (47)
The committee is responsible for the following:
1- Reviewing plans for the construction, paving, and development of squares, streets, public roads, and public parking lots in coordination with relevant committees and authorities.
2- Reviewing plans for the establishment and maintenance of bridges and tunnels in coordination with relevant authorities.
3- Reviewing plans for the establishment of schools, institutes, training centers, and various educational institutions.
4- Discussing and studying proposals for the establishment of slaughterhouses, factories, markets, exhibitions, ports, and all types of ship berths in coordination with relevant committees and authorities.
5- Studying and researching the establishment of cemeteries, determining their locations, specifications, and management procedures.
6- Studying the establishment, development, and maintenance of public gardens, parks, recreational areas, and beach protection in coordination with relevant authorities.
7- Providing opinions and comments on traffic movement where there is no specific provision in Federal Law No. (21) of 1995 regarding traffic and its executive regulations and amendments.
8- Making recommendations for improving traffic performance in consideration of jurisdiction rules.
9- Expressing opinions on problems arising from traffic congestion in coordination with other relevant authorities.
10- Taking into account the Emiri Decree No. (21) of 2002 regarding the establishment of the Sharjah Public Transport Corporation in the Emirate, and with the exception of light vehicles intended for personal use, the committee is authorized to issue licenses for all medium and heavy vehicles engaged in commercial activities. Canceled.
11- The council may delegate to the committee any other tasks related to traffic matters, in accordance with jurisdiction rules.
12- Other matters referred to it by the council.
– Financial and Administrative Affairs Committee
Article (48)
The committee is responsible for the following:
1- Inventorying the council’s assets and proposing regulations for their management and devising the best means for their utilization, as well as suggesting rules and regulations for their temporary use within the geographic and administrative jurisdiction of the council.
2- Providing opinions on the public benefit report for lands and private properties required for municipal projects or temporary land use for the same purpose, in accordance with the conditions set forth by existing legislation.
3- Considering its jurisdiction, studying projects related to tourism promotion and exploring suitable regulations to create a conducive environment for economic development projects and proposing the best methods to attract investors and tourists, in coordination with relevant authorities.
4- Studying matters related to municipal fees and other municipal charges, classifying them, proposing amendments, collecting them, and granting exemptions when necessary.
5- Supervising and monitoring the implementation of regulations, decisions, and laws related to municipal affairs.
6- Studying proposals related to financial and administrative matters and recommending suitable actions.
7- Supervising the necessary purchases for the council’s activities.
8- Studying matters related to expenditure within the allocated budgets for the council.
9- Studying and providing opinions on any obligation or monopoly related to the use of public facilities within the municipal jurisdiction.
10- Providing opinions on the legal and administrative procedures required for managing council properties, collecting their rents, and revenues.
11- Reviewing the existing administrative and financial conditions and providing opinions on them.
12- Studying the staffing needs of the executive body of the relevant municipality for performance improvement.
13- Studying the organizational structure, competency reports, promotions, and bonuses for the executive body of the relevant municipality.
14- Discussing the budget and final accounts and supervising them.
15- Supervising the execution and monitoring the implementation of budget items.
16- Supervising tenders and auctions, the methods of awarding them, and contracts that entail financial rights or obligations for the relevant municipality, in compliance with existing legislation.
17- Providing legal and financial opinions on other matters referred to it by the council.
18- Other matters referred to it by the council beyond what has been mentioned.
Committee for Arbitration, Contractor Disputes, Complaints, and Suggestions
Article (49)
The committee is responsible for the following:
1- While respecting the relevant legislation and without infringing upon the right to resort to the judiciary, the committee has the authority to consider and settle disputes brought before it based on the agreement of the disputing parties for arbitration or based on the agreement of the parties in a lawsuit before the courts to refer the dispute to it for arbitration.
2- To review complaints submitted to it by the contractor or the owner or their legal representatives against each other arising from the execution of a construction contract and attempt to reconcile their differences.
3- To receive complaints and suggestions related to municipal affairs from the public or referred to it by the council, concerning public services in terms of their nature, improvement methods, study them, verify them, and propose suitable solutions and measures for their resolution.
4- To grant approval, upon the request of the owner or their legal representative, to replace the contracted contractor with another contractor if it is proven to the committee that there are circumstances warranting this action, with the affected party being informed of their right to appeal to the competent court to suspend or modify this decision. The committee may establish the conditions it deems appropriate for issuing the referred decision. This does not apply to government construction projects unless they are referred to the committee with the approval of the relevant authority.
5- To propose fees related to the committee’s jurisdiction in coordination with other committees.
6- Other matters referred to it by the council beyond what has been mentioned.
Social Communication Committee
Article (50)
The committee is responsible for the following:
1- Reviewing citizens’ requests for residential lands that are presented through the Department of Planning and Surveying and managing them, and then making decisions on them.
2- Studying the rise in rates of certain negative social phenomena, such as marriages to foreigners, divorce, and spinsterhood, and proposing appropriate solutions in coordination with other relevant authorities.
3- Working to preserve Islamic values and Arab identity, in harmony with public morals, by addressing social pollution and foreign customs in coordination with other relevant authorities.
4- Handling matters referred to the committee by the Executive Council or the Higher Council for Family Affairs or any other specialized entity that promote social communication in areas related to the council’s jurisdiction.
5- Promoting the well-being of families socially, economically, and culturally in matters related to the council’s jurisdiction.
6- Proposing the distribution of municipal services to achieve social justice for citizens and residents within the administrative and geographic boundaries of the council.
7- Increasing awareness among school students about the quality of services provided by the relevant municipality in coordination with other relevant authorities.
8- Other matters referred to it by the council beyond what has been mentioned.
Committee for Compensation and Government Housing
Article (51)
In consideration of Executive Council Decision No. (13) of 2002 regarding the Permanent Committee to review requests for government housing in the Emirate or any other legislation issued in this regard:
the committee is responsible for the following:
1- Receiving requests for compensation for properties affected by planning and re-planning activities referred to it by the relevant department, studying them, and determining the eligible compensation amounts.
2- Preparing lists of citizens eligible for government housing, arranged according to priority and their social status, along with any other conditions set by the aforementioned Permanent Committee. The committee then submits these lists to the council after approval.
3- Providing input on the design and external appearance of government housing and their layouts in coordination with the relevant authorities.
4- Studying cases of property expropriation for public benefit purposes and expressing an opinion on the cash or in-kind compensation due to the affected party in exchange for their rights, in coordination with the relevant authorities.
5- Resolving disputes among participants in government compensation to safeguard the rights of each party, in coordination with the relevant authorities.
6- Handling other matters referred to it by the council.
